Terms of Service

1. Acceptance of terms
These Terms of Service (“Terms”) govern your use of DeskGreet (“we”, “us”, “our”), including our website, dashboard, web call widget, AI agents and APIs (collectively, the “Service”). By creating an account or using the Service, you (the “Customer” or “you”) agree to these Terms. If you are accepting these Terms on behalf of a company, you represent that you have authority to bind that company.
If you do not agree, do not use the Service.
2. Description of the Service
DeskGreet provides an AI receptionist that answers inbound voice calls, WhatsApp messages and web-chat messages on your behalf — including booking appointments, taking orders, qualifying leads and writing results back to your tools. The Service is delivered as a hosted SaaS via your dashboard, our API, and embeddable widgets.
We may add, modify, or remove features at any time, with reasonable notice for material changes.
3. Accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the security of your credentials and for all activity under your account.
- You must be 18 or older, or the age of majority in your jurisdiction, to use the Service.
- You may not share an account across multiple legal entities without our written consent.
4. Acceptable use
You agree not to use the Service to:
- Place outbound spam, scam, robocall, or unsolicited marketing calls (the Service is built for inbound use; outbound use, where supported, requires consent and compliance with TCPA, GDPR, ePrivacy and equivalent laws).
- Impersonate a person or organization, or misrepresent affiliation with anyone.
- Provide medical, legal, financial, or other regulated advice without proper authority and disclaimers.
- Process the personal data of children under 16 without verifiable parental consent.
- Reverse-engineer, scrape, or attempt to extract source code, models, or training data.
- Interfere with the Service's infrastructure or other Customers' agents.
- Use the Service in violation of any applicable law, sanction, or export control.
We may suspend or terminate accounts that violate this section, including without notice for active fraud or abuse.
5. AI-generated content
The Service uses third-party large language models and speech models to generate replies in real time. AI output may be inaccurate, incomplete, or unexpected. You are responsible for:
- Reviewing the script, knowledge base, and tool integrations you give the agent.
- Disclosing to your end-customers (callers, message senders) that they are interacting with an automated system, where required by law.
- Verifying any high-stakes outcome the agent produces (price quotes, medical triage, legal commitments, financial advice) before relying on it.
We do not guarantee that AI output will be accurate, fit for any particular purpose, or free of bias. You assume the risk of relying on AI output.
6. Compliance with laws
You are solely responsible for ensuring that your use of the Service complies with all laws applicable to your business and your end-customers, including:
- Telephone consumer protection — TCPA (US), CASL (Canada), PECR (UK), ePrivacy (EU) and equivalents.
- Data protection — GDPR, CCPA/CPRA, UK GDPR, PIPEDA, PDPL and equivalents. We act as a data processor; you are the controller.
- Recording disclosure — single-/two-party consent rules vary by jurisdiction. You must obtain any required consent.
- Industry rules — HIPAA (healthcare), PCI-DSS (payment), FINRA / SEC (financial), and equivalents. The Service is not currently HIPAA-eligible; do not transmit PHI through it.
We provide a Data Processing Agreement (DPA) on request for Customers subject to GDPR or equivalent regulations.
7. Pricing, payment and refunds
- Pay-as-you-go plan: $29/month base, includes 60 minutes of agent time. Additional usage billed at $0.15 per minute. New accounts receive $10 in free credit on signup. All amounts in USD.
- Custom plans: as agreed in writing.
- Charges are billed monthly in arrears via Stripe. Failed payments may result in suspension after 7 days' notice.
- Fees are non-refundable except where required by law. Unused free credit expires 90 days after issue.
- We may change pricing with at least 30 days' notice via email or dashboard.
8. Cancellation and termination
- You may cancel your account at any time from the dashboard or by emailing us. Cancellation takes effect at the end of the current billing period.
- We may terminate or suspend your account for material breach, non-payment, fraud, or as required by law. Where reasonable, we will provide notice and a chance to cure.
- On termination, you may export your data for 30 days; after that we may delete it.
9. Intellectual property
We own the Service, including all software, models, designs, branding and documentation. You receive a non-exclusive, non-transferable license to use the Service while your account is active.
You own the data you submit (configuration, scripts, recordings of your end-customers' calls). You grant us a limited license to host, process and display that data as needed to provide the Service.
Feedback you give us about the Service is non-confidential, and we may use it without restriction.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties — express, implied or statutory — including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI output will meet your requirements.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) USD 100.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenues, lost data, or business interruption — even if advised of the possibility.
These limitations do not apply to liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless DeskGreet and its operators against any claim arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law, or (d) any content or instructions you provide to the agent.
13. Modifications
We may update these Terms from time to time. Material changes will be announced by email or via the dashboard at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Any dispute will be brought in the courts of London, England, except where mandatory consumer-protection law gives you the right to bring a claim in your country of residence.
15. Miscellaneous
- If any provision is found unenforceable, the rest remains in effect.
- Our failure to enforce a right is not a waiver.
- You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy and any DPA, are the entire agreement between us.
